Acceptance of these terms
These Terms of Service apply when you access or use Gesture Synth, the free browser-based musical instrument maintained by TideSparrow. By using Gesture Synth, you agree to these terms. If you do not agree, do not use the service.
What Gesture Synth provides
Gesture Synth uses your device's camera, browser-based hand tracking, and the Web Audio API to turn hand movement into chords, theremin-style tones, loops, and downloadable recordings. The core instrument is provided without an account or payment.
The service depends on a compatible device, camera, browser, graphics support, and browser media APIs. Performance and available recording formats may vary by device and browser.
Camera permission and your recordings
You decide whether to grant camera access and whether to create or download a recording. The instrument does not request microphone access. Recordings combine the camera canvas with sounds generated by Gesture Synth and are created locally by your browser.
Gesture Synth does not host or back up your recordings. You are responsible for saving and protecting exported files. You must have any permission required to capture, use, or share another person's image, performance, or other rights. Do not use the recording feature in a way that violates privacy, publicity, copyright, or other applicable laws.
Acceptable use
You agree not to:
- Use Gesture Synth for an unlawful purpose or in violation of another person's rights.
- Record or distribute another person without any consent required by law.
- Attempt to disrupt, overload, damage, or gain unauthorized access to the website or its supporting systems.
- Introduce malware, automated abuse, or other harmful code or traffic.
- Misrepresent your relationship with Gesture Synth or TideSparrow.
We may restrict access when reasonably necessary to protect the service or respond to misuse.
Your content and intellectual property
As between you and Gesture Synth, you retain the rights you hold in your original performance and locally created recording. Gesture Synth does not claim ownership of those recordings. You remain responsible for any third-party music, images, performances, or other material included in what you create or share.
Gesture Synth's name, website design, documentation, original visual assets, and software are protected by applicable intellectual-property laws. Your use of the website does not transfer ownership of those materials or grant rights beyond what is necessary to use the service. Third-party software and resources, including MediaPipe, remain subject to their own licenses and terms.
Third-party services and links
Gesture Synth relies on browser technology, Cloudflare R2 storage, and third-party content-delivery services to load the MediaPipe runtime and tracking models. Google-hosted models may be used as a fallback when our primary model download is unavailable. The website may also link to external sites. We do not control third-party services, browser behavior, availability, security, or terms, and are not responsible for their content or practices.
Availability and changes
Gesture Synth is provided as a free creative tool. We may fix, change, suspend, or discontinue features or the website at any time. We do not promise uninterrupted availability, compatibility with every device, or permanent storage of settings, loops, or recordings.
Disclaimer
To the fullest extent permitted by law, Gesture Synth is provided "as is" and "as available," without warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, availability, or error-free operation. Nothing in these terms excludes a warranty or consumer right that cannot lawfully be excluded.
Limitation of liability
To the fullest extent permitted by law, TideSparrow and the Gesture Synth maintainers will not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of data, recordings, profits, or opportunity arising from use of or inability to use the service. Where liability cannot be excluded, it is limited only to the extent permitted by applicable law.
Changes to these terms
We may update these terms when the service or legal requirements change. The date at the top of this page shows the latest revision. Continuing to use Gesture Synth after an update means you accept the revised terms to the extent allowed by law.
